South El Monte regulates ADUs ministerially under Municipal Code Chapter 17.12. Because the city's ordinance predates the latest state updates, state minimums control: a city must permit an ADU of at least 800 sq ft at 16 ft height regardless of local standards, and cannot cap a studio/one-bedroom below 850 sq ft or a two-or-more-bedroom unit below 1,000 sq ft (Gov. Code §66321). A JADU is up to 500 sq ft within an existing/proposed single-family dwelling.

South El Monte reviews ADUs ministerially against objective standards under Municipal Code Chapter 17.12, with no discretionary design review. State law (Gov. Code §66317) bars the city from applying any local standard outside the ADU statute to approve or deny an ADU, so any objective design standard cannot exceed state limits or block an 800 sq ft ADU.

Under state ADU law and South El Monte's Chapter 17.12, a new detached ADU requires no more than a 4-ft side and rear setback, and the city may not impose setback or front-yard requirements that would preclude an 800 sq ft ADU (Gov.
